Challenging SEIAA revocation. Brigade appeals eco-clearance decision. Wetland controversy unfolds.
Discover MoreThe State Level Environment Impact Assessment Authority (SEIAA) cancelled the EC for Brigade Morgan Heights on May 12, 2026. The project proposed the construction of around 1,250 residential units on nearly 14.7 acres within the notified Ramsar wetland area. The project was estimated to involve an investment of around Rs 2,000 crore.
The clearance was rescinded following SEIAA's 1,005th meeting on 8 May 2026 based on inputs from the Principal Chief Conservator of Forests and the Member Secretary of the Tamil Nadu State Wetland Authority. The project had commenced without obtaining mandatory approval from the Tamil Nadu Wetlands Authority. The environmental clearance was granted by the SEIAA on January 20, 2025, and the Chennai Metropolitan Development Authority (CMDA) issued planning permission three days later.
Brigade's Response and Appeal
Brigade Group and Morgan Asia have filed an appeal before the Supreme Court of India, where the matter is currently under consideration. Brigade Group has challenged the revocation, describing the decision as 'legally unsustainable' and asserting that all statutory approvals for the development had been duly obtained. Brigade maintains that the project land comprises private patta land classified as dry land in revenue records and does not fall within any officially notified wetland area under applicable regulations.
A Public Interest Litigation (PIL) challenging these approvals was subsequently dismissed by the Madras High Court in February 2026. Brigade notes that it issued public notices at the time of entering into the JDA and also at the time of securing the EC in leading newspapers, and no objections were received whatsoever.
Impact on Project Timeline and Buyers
BMH has total sales potential of 2 msf of which phase 1 with 1msf was launched in Q1FY26 and later paused when petition filed in Madras High Court. It planned to launch phase 2 in Q1/Q2FY27 however that is now delayed until definitive clarity. The company said it is pursuing all available legal and regulatory remedies while maintaining that the cancellation order could have broader implications for landowners and development projects across South Chennai.
Environmental and Wetland Concerns
Officially designated as a Ramsar Site of International Importance on 8 April 2022, the Pallikaranai Marsh Reserve Forest is the last surviving natural wetland ecosystem in Chennai. Anti-corruption NGO Arappor Iyakkam had advocated against the project saying that it occupied the ecologically vital marshland in Pallikaranai. The organisation raised complaints about the project approvals since October 2025, and urged the Chennai Metropolitan Development Authority (CMDA) to also revoke the project's planning permission.
